PB Mission and Organization

The Planning Board is established and governed by the New Jersey Municipal Land Use Law (N.J.S.A. 40:55D1 et. seq.) and the Code of the Township of Harding (Section 7-32).  The Planning Board consists of 9 regular members and 2 alternates.  Planning Board members are appointed by the Township Committee and volunteer their time and expertise without compensation.  Planning Board members are divided into Classes (I to IV).  The Class I member is the Mayor or Mayor's Designate.  The Class II member is an official of the Township other than a member of the Township Committee.  The Class III member is a member of the Township Committee other than the Mayor.  The Class IV members are residents appointed by the Mayor.  Class IV members serve 4-year terms.  Class I and III members serve 1-year terms.  Class II members serve a 3-year term.

The Planning Board is authorized to: adopt and amend the Township's Master Plan (you may view the Master Plan by clicking here); hear and decide development applications involving subdivisions and site plans for permitted uses and conditional uses; make recommendations concerning the official map, zoning map and zoning and land use regulations; and grant variances under certain circumstances in connection with site plan and subdivision review.

The Planning Board Attorney, Township Engineer, Township Planner, and Health Department review each application for the Board.  In addition, the application may be reviewed by the Environmental Commission, Historic Preservation Commission and Shade Tree Advisory Committee for recommended conditions to be included in an application.

Planning Board Schedule and Process

Planning Board Schedule

For 2013, the Planning Board meets on the fourth Monday of each month at 7:30 P.M in the Courtroom in the Municipal Building, with the exception of May, November and December when the meeting is on the third Monday at 7:30 P.M.  Special meetings are scheduled when needed.  Public notice of the meeting agenda is posted in the Municipal Building.

Application Filing Procedures

An application must be submitted according to the type of proposed action.  Application forms are available in the Planning Board office.  Applications are reviewed for completeness by the Township Engineer before being placed on the Planning Board agenda.

Public Notice Requirements

Pursuant to N.J.S.A. 40:55D-12, the applicant is required to serve public notice at least 10 days prior to the date of the Planning Board hearing.   Applicants may contact the Tax Department for the list of property owners to be notified.  Attorneys usually perform this task for applicants.  Notice is required to be published in one of the Township's official newspapers ( and the ) at least 10 days prior to the hearing.

Decision Process

In accordance with the New Jersey Municipal Land Use Law (MLUL), the Planning Board is required to reach a decision on an application in a specified period of time.  The amount of time is based on the type of application.  Once the application is deemed complete, the MLUL clock is started.

Resolutions

Once a decision has been reached by the Planning Board, the Planning Board Attorney prepares a resolution which is a record of the Board's decision detailing specific conditions.  A resolution of approval is needed in order to obtain a building permit.   Conditions of the resolution must be complied with before the plans will be signed and distributed.

Notice of Decision

Once action is taken by the Planning Board, a Notice of Decision is published in the local newspaper.
